They should also be careful with their quotes in their financials. Tim Cook in the last conference call basically gave Microsoft and Amazon ammunition when he said things "We have the largest app store", making the term quite generic and descriptive. This doesn't help their case at all.

I am not sure if you know, but there are differences between trademark law and patent law. In this case, the one you cited (which I studied), Amazon was protecting its system or process by which they achieved a 1-click process. This is a clear cut patent infringement.
However, the current article deals with a trademark issue, which is different from patent law. In this instance, we are dealing with generic terms (App Store) and Apple cannot trademark that. As another member said, Apple does not have a trademark in App Store ;)

In Australia (where Im from), the market is dead ! Most Apple Stores are large and if you ive in the Country - they don't exist. The rest of Asia is like that.
In Japan (where I live), alot of people have an Ipod but NOT a Macintosh...

As has been reported, it's because of high demand due to the back-to-school season. Apple is having difficulty keeping up with that demand.
Apple's wait to use new processors is brilliant, in my opinion. This is a crucial point in the buying season - students need new computers now, not in a month or two.
Quite a few people on this board want Apple to simply announce the next Macbook Pro with Merom, even if it has delayed shipping. That would, however, compel students who need computers now to look elsewhere.
The only reason why Dell can announce Merombooks now is because they offer both the Yonah chips (shipping today) and the Merom chips (shipping in 10-20 days) - I don't see Apple offering both configurations simultaneously.

I forgot to mention this in my earlier post.
Netflix and Blockbuster's Mail Delivery Business Plan is flawed. Here's why:
1) Physical DVDs starch and become useless after many times of use or by shipping and handling.
2) Shipping Cost is only going to increase and this is an overhead that NO COMPANY WANTS. Plus having to maintain distributing centers in each state with physical inventory that has to be maintained, organized and checked for quality control.
3) People watch movies on an impulse. Do you ever plan what movie you are going to watch several days in advance? NO. I know at my house, we subscribed to Blockbusters DVD Mail Service only because we get 2 Free in-store movie rentals each month. This is because I don't know what I want to watch, until I go to the store and see what they have available and what MOOD we're in. Maybe I felt like a Comedy a couple of days ago, but now I want a Thriller, so instant gratification is a BIG KEY to this new service from Apple. Whatever mood you are in, you don't have to wait a few days to receive it from Netflix, just to play it and it's so starched up that you are not able to view it.

Thats exactly what it does do. Swiping up, while hovering over an icon in the dock invokes application spotlight. Works for both running/not running apps. Quite handy. Especially since it works between desktops and even full screen apps.

Yeah, if it's $9.99 to rent, it's going to fail. $1.99, might be worth it. I'm sure a lot of people will be happy, then a lot of people will complain. Both with have good points, but the rest of us won't care.

Your location is *never* a secret, unless you're the President and it's a national crisis.
There are many people whose movements are best kept secret from certain others, with risk of life if revealed.
Battered women or kids in a secret shelter home, witness protection participants, undercover agents of all sorts, dissidents and rebels.
On a less serious note, there are probably some bosses who gave out iPhones, checking company iTunes hosts this weekned to see if their employees' travel receipts and sick days match their movements.

I read the police in Michigan were downloading info from people's iPhones on traffic stops ... only a matter of time before some innocent people get trumped up on bogus charges ... police have been known to have tunnel vision. (example ... sir, what were you doing at Avenue and Main street at 3pm this afternoon?)

Seems to me this might be a way not for Apple to release an 8 core machine, but perhaps to release a one-chip, 4 core Mac Pro. That might result in slightly lower manufacturing and/or parts costs.

I'd have to call this one disappointing at best....mainly because I think the Mini is just too expensive to be considered any kind of "entry level" machine. Entry level for Apple, sure. But if this is the offering that is supposed to make people think a Mac is an "affordable" alternative to a PC, I don't think it does that.
I don't think Apple wants to wade in the disposable $299/399 territory, but $499 looks an awful lot better than $599....

seriously i would be stoked if they released an ULV Mac Mini with a 100GB HDD for all your audio and video needs. Ability to plug a 30" ACD would be nice, as 23" isn't that big for a TV. Built-in eyeTV equivalent, better remote... i want one!

I'm getting a little confused, are you trying to say keyboards are not easy input methods? QWERTY keyboards are FULL keyboards like the ones you and I are using to type in these forums. I completely agree with you that phone/PSP-esque multi-press solutions are not good for extended use, which is why I think the MYLO is such a good example of what can be done with a "portable WiFi" device because it has a full keyboard.
The iPod would continue to sell "pure" (and I know I'm being contradictory as my original 1Gen iPod is a much different machine than my vid iPod but we're talking of the iPod as a basic walkman-type device) as there will always be demand for a music/media player at a fairly reasonably price. Either through attrition, improvements to current features (bigger screens, easier input methods, color screens, longer battery life, new battery types, etc) there will ALWAYS be demand for the iPod.
As you point out, the current iPod isn't a "pure" machine either. Apple have realised that they have to continually offer new things and more functionality to continue to sell and tempt existing customers to upgrade. As a music player my 4G iPod is more than sufficient: It has a nice enough size, decent enough battery life, 40Gb of space and music will not sound any better no matter how bigger the screen is. If the iPod is only to be a "pure" walkman then there is no reason for me to ever buy a new iPod unless it breaks, which is bad for Apple. Apple realise this, and validate my point by adding extra features to the iPod like photo and video support. Things like a web browser, IM etc are also just natural evolutions of the device.
Using your reasoning, why not add all these features and more to every TV on the market cuz, "Hey, pure machines are going to be extinct soon. Everybody has a TV so we're not going to be selling any more pretty soon... Let's add keyboards and webcams to the remotes. make 'em with wireless net access, hell, throw in Vista and a dock for the refrigerator to show you how much beer is left so you don't have to get up!!!" That's not what happens. Improvements come and are incorporated and even stick around if people like them or are weeded out in the next model. But those improvements are all related to the TV viewing experience. Remember webTV? and that was only offered as a separate add-on if memory serves.
Actually that's exactly what's happening. TV's now are having HDD's built in, PC's are having media centre's built in. Here in the UK, with the BBC, the difference between TV and computer are being blurred. A few minutes ago I watched a TV show on this computer steamed from the BBC.

And precisely what other Apple product sales would a MYLO iPod cannibalise? What competing product does Apple offer?

A laptop, a comm device of some sort and my iPod would do anything I need to do as a civilian back in the world. Obviously I carry much more here as I have the desire to make it back to the real world but that's not what the real market is.
